Specialisation course in Human Rights and the Powers of Public Administration. The protection of non-jurisdictional human rights in relation to Public Administration

This specialisation course will pursue a multidisciplinary approach as regards the protection of human rights within local, regional, national and supranational contexts. With this objective in mind the course will cover the historical origins of the protection of human rights and the different systems of protection in the subjective juridical spheres (national constitutional systems, foreign constitutional systems of regulations, community systems). Attention will be given to the modalities of defending civil liberties within local, regional and supranational contexts (the European Mediation Association, as conceived by the treaties as well as the Charter of Fundamental Rights of the European Union). The principal aim is to convey pertinent information about the operations of administrative institutions for the protection of human rights that implement constitutional regulations by way of operations that assist the work of administrators. Firstly, the activities of civil rights institutions will be examined from an analytical and empirical point of view. Secondly, the course will deal with aspects concerning the coordination of the tasks and responsibilities of defending civil liberties at various levels of administration above all as regards the relationship between subnational entities and the constitutional standards of supranational entities of protection. From a professional point of view the course intends to update and expand the knowledge needed for effective operations by public administrators in the field of promoting civil rights. A further objective is to examine the theme of the institutional relationship between the local institution for civil liberties and the constitutional framework. To this will be added the role of European mediation within the context of the relationships with national entities. Although the contents of the course pertain to current law, it is also intended to focus attention on institutional and operational aspects of the national-level ombudsman who, until the role is legally established, is presently substituted by the regional-level ombudsman.
